Don’t Litigate - Mediate

  . . . is the rather surprising message from WJM’s Head of Commercial Dispute Resolution, Liam Entwistle.

Liam is a firm fan of this form of dispute resolution and believes that many disputes are better suited to mediation than litigation .

“Many people think mediation is just for employment issues. It isn’t. It can be used far more widely to resolve many types of business or personal conflict. Conflict is a fact of life and using a ‘one size fits all’ approach through litigation can be much more damaging whether to business or personal relationships” said Liam.

The WJM team has successfully used mediation tools with clients in disputes ranging from construction and contracts.

Access to Mediation

Conflict is costly.  For most people participating in a dispute with another is the most worrying and expensive “brush with the law” they can ever have.  The time, money and stress it costs spent could be better spent devoted to our businesses or to our normal lives. 

This is why, at WJM, we have developed expertise in finding the right way to resolve our clients conflicts.  Conflict resolution is not all about going to Court.  There are many ways to resolve a dispute and Mediation is one of them.

Mediation is a form of conflict resolution which has benefits for clients.  It can be quicker and cheaper than any other form of conflict resolution and also gives parties involved a closer control over the outcome.  It focuses on what parties need rather than what parties positions are. 

WJM Conflict Resolution lawyers will be able to spot when your conflict or dispute could be resolved by mediation, advise you in relation to that and prepare you for the process.  We will guide you through the Mediation process in such a way that you can reasonably expect to achieve your aims and meet your needs in any result. 

Providing Mediators for You

One of the benefits of mediation, apart from time and cost is that it can preserve and even improve your relationships.  As a result, it is perfect for resolving conflict in the workplace and it is usually a better tool for doing so and for getting employees back to work than disciplinary procedures or grievance procedures.  This not only makes your workforce more contented and more productive but reduces the cost of conflict and helps to prevent Tribunal claims from arising. 

We are able to offer Mediators who can mediate between management and employees or between employees with a view to resolving the conflict, helping parties reach their own solution and preventing a costly drain on resources. 

Our Mediators adhere to a Code of Conduct and have a strict confidentiality policy.  Referrals to our mediation service can be made on line by emailing Liam Entwistle through lae@wjm.co.uk

Parties will be expected to enter into an Agreement to Mediate.

We have considerable experience to the table assisting our clients with mediation.  The head of our Conflict Resolution Service Liam Entwistle is an Accredited Mediator and Associate of the Chartered Institute of Arbitrators, an Affiliate of the Chartered Institute of Professional Development and a member of the Employment Law Group of the Law Society of Scotland.  Steven Docherty who is also a member of the team is also an Associate of the Chartered Institute of Arbitrators.
