In addition, we will take a look at the contractual remedies of unjustified enrichment and unilateral error, possible reform for unincorporated associations such as golf clubs and we will provide you with our thoughts on the the forthcoming Arbitration (Scotland) Act 2009 when a new era will dawn for Scottish arbitration.
Finally, as always we will round off the newsletter with our humorous “You Couldn’t Make It Up” section which this month is a comical legal story from India!

In this month’s edition we report to you on how Twitter defeated a Court injunction in England, we examine a Court of Session case relating to director’s conflict of interests, analyse unauthorised agency, and we give you the best bits (in our humble opinion) of the new 700 page Companies Act 2006 to save you the bother of reading it!
We also cast a glance at an interesting Spanish Employment Tribunal decision where an angry Spaniard called his boss a “son of a b***h” but still won his unfair dismissal claim, we take a cursory look at a brave but ultimately fruitless attempt by a charity to obtain reduced business rates and analyse a recent Sheriff Court case in Aberdeen concerning whether a salesman’s banter can be used to pursue a negligent misrepresentation action.
Finally, we update you on the UK Supreme Court’s decision on the bank charges’ test case and as it is St Andrew’s Day this month, our humorous “You Couldn’t Make It Up” section is a funny legal story from Scotland!

We also warn you about the dangers of emailing (as if you need told!) and finally touch on a Spanish legal procedure that can be used as a last ditch attempt by property owners to escape burdensome mortgage repayments.
